NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
The “Win a #SpicySix Contest” is sponsored The Spice Co. Inc. via www.thespiceco.ca (“Sponsor”). This contest is governed by these official rules and regulations (“Official Rules”). By participating in the contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the contest, as determined by Sponsor and its agents, are final in all respects. The contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, Twitter, or any other social media platform. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook, Instagram, Twitter, or any other social media platform.
HOW TO ENTER
To enter The Spice Co. Inc. “Win a #SpicySix Contest” (the “Contest”) eligible contestants have to
(A) “Like” us on Facebook; @TheSpiceCo and/or “Follow” us on Instagram; The Spice Co. @thespicecompany and/or “Follow” us on Twitter; @TheSpiceCo1
(B) Submit a photo, video and or recipe using at least one of The Spice Co. Inc.’s products. Submissions can be made in any of the following formats jpeg, png, pdf, mp4, word or other similar formats. Submissions can be made by mentioning “The Spice Co.” in your social media post using the hashtag #SpicySix via any of The Spice Co. Inc.’s social media platform’s application messaging system(s), email to [email protected] or mailed to “Win a #SpicySix Contest”, c/o The Spice Co. Inc., 2511 15th Line, Selwyn, Ontario, Canada K0L 2H0
You may enter as many times as you wish.
ELIGIBILITY
The Contest is open to legal residents of their respective countries where not prohibited by law, who are eighteen (18) years of age or older at the time of entry who have Internet access and a valid e-mail account prior to the beginning of the Contest Period. Sponsor has the right to verify the eligibility of each entrant.
1.1 Eligibility: The Spice Co. Inc. ““Win a #SpicySix Contest”” (the “Contest”) is open to all residents of Planet Earth who have reached the age of majority in their Province, State, and or Geographic Region of residence, except employees, retirees of The Spice Co. Inc. and its affiliates, franchisees, agents, associates, dealers, representatives, advertising and promotional agencies and members of the immediate family of these employees and retirees or any person with whom they are domiciled (“Customers”).
1.2 Contest Period: Starting on 12:00 a.m., Eastern Time, January 1st, 2018 to 11:59 p.m., Eastern Time, December 31, 2018, Customers may participate in the Contest by submitting an entry to The Spice Co. Inc. as indicated in section 3.9 of these Contest rules (the “Rules”).
1.3 Contest Entry: by submitting an entry (in accordance with section 3.9), eligible Customers will be entered into the Contest for one (1) chance to win (i.e. one entry) the Prize.
1.4 Awarding of Prize: The Prize will be awarded to the Customer whose contact information (name, telephone number or email address, address) has been given by the entrant indicated on the mail in entry and who has complied with these Rules.
2. PRIZE
2.1 Prize: The Contest is divided in twelve (12) contest periods as indicated below. There will be one (1) prize awarded for each contest period during the Contest as follows (twelve (12) prizes in total to be awarded during the Contest):
Contest Period 1 – on 12:00 a.m., Eastern Time, January 1st, 2018 through 11:59 p.m., Eastern Time, January 31st, 2018;
Contest Period 2 – on 12:00 a.m., Eastern Time, February 1st, 2018 through 11:59 p.m., Eastern Time, February 28th, 2016;
Contest Period 3 – on 12:00 a.m., Eastern Time, March 1st, 2018 through 11:59 p.m., Eastern Time, March 31st, 2018;
Contest Period 4 – on 12:00 a.m., Eastern Time, April 1st, 2018 through 11:59 p.m., Eastern Time, April 30th, 2018;
Contest Period 5 – on 12:00 a.m., Eastern Time, May 1st, 2018 through 11:59 p.m., Eastern Time, May 31st, 2018;
Contest Period 6 – on 12:00 a.m., Eastern Time, June 1st, 2018 through 11:59 p.m., Eastern Time, June 30th, 2018;
Contest Period 7 – on 12:00 a.m., Eastern Time, July 1st, 2018 through 11:59 p.m., Eastern Time, July 31st, 2018;
Contest Period 8 – on 12:00 a.m., Eastern Time, August 1st, 2018 through 11:59 p.m., Eastern Time, August 31st, 2018;
Contest Period 9 – on 12:00 a.m., Eastern Time, September 1st, 2018 through 11:59 p.m., Eastern Time, September 30th, 2018;
Contest Period 10 – on 12:00 a.m., Eastern Time, October 1st, 2018 through 11:59 p.m., Eastern Time, October 31st, 2018;
Contest Period 11 – on 12:00 a.m., Eastern Time, November 1st, 2018 through 11:59 p.m., Eastern Time, November 30th, 2018;
Contest Period 12 – on 12:00 a.m., Eastern Time, December 1st, 2018 through 11:59 p.m., Eastern Time, December 31th, 2018
Each prize consists of six (6) individual packages of The Spice Co. Inc. line of spice rubs and/or blends (“Prize”). There will be a random draw for each Contest Period (See section 2.3). Each Prize must be accepted as awarded. No cash alternatives, substitution or transfers of the Prize will be allowed. Each Prize will be forwarded to the winner within four (4) to six (6) weeks from the date when the winner is selected by The Spice Co. Inc.
2.2 Odds: The odds of being randomly selected to win a Prize depend on the total number of eligible entries received as all qualified entries are rolled over and entered into each of the twelve (12) contest periods (See Section 2.1).
2.3 Prize Draw: The Prizes (twelve in total) will be awarded by pulling an entrants name out of a bucket, which will be captured on video and posted on-line (one draw per Contest Period, twelve in total) from all eligible Contest entries received during the applicable Contest Period, Each draw to be held at 10:00 am at 2511 15th Line Selwyn, Ontario on the following dates (“Draws”):
Draw for Contest Period 1 –February 7th, 2018;
Draw for Contest Period 2 – March 7th, 2018;
Draw for Contest Period 3 – April 7th, 2018;
Draw for Contest Period 4 – May 7th, 2018;
Draw for Contest Period 5 – June 7th, 2018;
Draw for Contest Period 6 – July 7th, 2018;
Draw for Contest Period 7 – August 7th, 2018;
Draw for Contest Period 8 – September 7th, 2018;
Draw for Contest Period 9 – October 7th, 2018;
Draw for Contest Period 10 – November 7th, 2018;
Draw for Contest Period 11 – December 7th, 2018;
Draw for Contest Period 12 – January 7th, 2019;
2.4 Notification of Selection: The selected winning Customer(s) will be announced across all of The Spice Co. Inc.’s social media platforms at least once, and by direct message and/or e-mail (using the contact information provided by Customer at time of entering the Contest) at least three (3) times within the fourteen (14) days after the Draw. If the selected Customer cannot be contacted in that time, another Customer will be randomly selected and the initial selected Customer will be disqualified and will have no recourse towards The Spice Co. or anyone involved in the Contest. In order to win, the selected Customer must first correctly answer, unaided, a time-limited, mathematical, skill-testing question to be administered by telephone, and he or she will be required to sign a standard “Declaration and Release Form” confirming compliance with the Contest Rules, acceptance of the Prize as awarded and releasing The Spice Co. from all liability relating to the Contest. No substitution for, or transfer of the Prize, will be allowed. The selected entrant will have seven (7) days from the date of receipt to return a signed copy of the Declaration and Release Form to The Spice Co. Inc. or its representative. If the selected Customer does not do so within this period of time, another Customer will be randomly selected and the initial selected Customer will be disqualified and will have no recourse towards The Spice Co. Inc. or anyone involved in the Contest.
3. GENERAL RULES
3.1 Each Prize claim is subject to verification by The Spice Co. Inc. and/or its designated representatives. Entries made with multiple addresses, under multiple identities, or through the use of any device or artifice to enter multiple times or entries that are in excess of the permitted number of entries during the Contest period are automatically void. All Contest entries obtained through unauthorized sources or which are incomplete, illegible, mutilated, altered, reproduced, forged, irregular or fraudulent in any way or otherwise not in compliance with these Rules are automatically void. The Spice Co. Inc. will be the sole and final reference source in validating a Prize claim.
3.2 By participating, each Customer and selected winner agrees: (a) to be bound by these Rules and the decisions of The Spice Co. Inc., (b) to release and hold harmless The Spice Co. Inc., its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, agents and representatives including advertising and promotion agencies, from any and all liability for claims/damages including, but not limited to, claims/damages for personal injury, for property damage with respect to acceptance, possession or use or misuse of the Prize or participation in the Contest; (c) to permit The Spice Co. Inc. to use his/her name, address, city, province, of residence, photograph, video, or any likeness for advertising or publicity purposes without any additional compensation and (d) the winner agrees to sign a Declaration and Release Form to this effect.
3.3 The decisions of The Spice Co. Inc. in relation to this Contest will be final and binding on all entrants.
3.4 The Spice Co. Inc. shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, faulty, incomplete, incomprehensible, or erased computer or network transmissions, line failures of any telephone network, failure of computer equipment, software, inability to access any online service or web site, inability to submit the online requirements of the contest , or any other error or malfunction, or any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or uploading and/or downloading any materials in this Contest, or for late, lost, stolen, postage due, illegible or misdirected entries.
3.5 The Spice Co. Inc. will not be responsible for lost, stolen, illegible or destroyed purchase receipts.
3.6 The Spice Co. Inc. reserves the right to cancel, terminate, or suspend this Contest, at its sole discretion, in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest, subject, in Quebec, to the approval of the Régie des alcools, des courses et des jeux.
3.7 If a selected entrant is awarded the Prize due to a system error, malfunction or defect the Prize will be returned to the Prize pool, to be re-awarded.
3.8 Under no circumstances will The Spice Co. Inc., its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies be required to award more Prizes than what is indicated in these Rules or award the Prizes other than in accordance with these Rules.
3.9 No purchase is necessary. To enter without any purchase a Customer may hand print their name, address, email address, postal code and phone number on a plain 3” x 5” piece of paper and sign it. Place the entry form in an envelope and mail it with sufficient postage to: “Win a #SpicySix Contest”, c/o The Spice Co. Inc., 15th Line, Selwyn, ON K0L 2H0.
Entries must be postmarked no later than December 31st, 2018. Limit of one (1) entry per envelope with sufficient postage. All mail-in entries will bear the same odds as online submissions received by email and/or social media platforms and/or their messaging servers.
3.10 The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted in view of said laws. The personal information provided to enter the Contest will be used only to administer the Contest, and for no other reason.
3.11 For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

ADDITIONAL LIMITATIONS
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
INDEMNIFICATION AND LIMITATION OF LIABILITY
By entering the Contest, each entrant agrees to indemnify, release and hold harmless Sponsor, affiliate and subsidiary companies, all social media platforms and app’s including but not limited to Facebook, Instagram and Twitter, administrator, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly from the entrant’s participation in the Contest and the Acceptance use or misuse of any Prize that may be won. Sponsor and its affiliate and subsidiary companies do not make any warranties, express or implied as to the condition, fitness or merchantability of the Prize. Sponsor and its subsidiaries, affiliates, advertising and promotional agencies, and all of their respective Officers, Directors, Employees, Representatives and Agents disclaim any liability for damage to any computer system resulting from access to or uploading and/or downloading of information or materials connected to the Contest.
PUBLICITY
By participating, each entrant grants Sponsor permission to use his/her name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law.
